Freedom of expression, freedom of speech and freedom of media is granted as basic rights by the Constitution of Bangladesh. Yet, there are a few limitations given by the constitution, it ensures the opportunity of the freedom of speech and freedom of the media. And if people cannot express their thoughts, ideas and opinions freely they will be out of participation within the society. Effective participation of the citizens is very important for a democratic society.
In recent years, there have been numerous cases of journalists being arrested, harassed, and prosecuted under the Digital Security Act, 2018 for their reporting, leading to widespread criticism from civil society and media organizations. In response, several legal challenges have been filed, arguing that the act violates constitutional guarantees of freedom of expression and the right to information.
Against this backdrop, this study aims to determine the scope of media independence in the Digital Security Act, 2018. Specifically, it will analyze the provisions of the act that relate to freedom of expression and the press, and assess the extent to which they may be used to limit media independence.
By providing a comprehensive analysis of the Digital Security Act, 2018 and its impact on media independence, this study will contribute to ongoing debates around the regulation of online content and the protection of freedom of expression in the digital age.
